Please read these Terms and Conditions (“Terms”) carefully before using the services provided by Silver Dog Studios (“we”, “us”, “our”) through https://www.silverdogstudios.co.uk (“the Website”).

By placing an order with us or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use our services.

1. Services

Silver Dog Studios provides photographic and film scanning, restoration, digitisation, printing and related imaging services.

We reserve the right to refuse any order where we reasonably believe the material is unlawful, infringes the rights of another person, or is otherwise unsuitable for processing.

2. Orders

When placing an order, you may be asked to provide information including your name, postal address, email address and telephone number.

This information is used solely for the purpose of providing our services, fulfilling your order, communicating with you and complying with our legal obligations. It will be handled in accordance with our Privacy Policy.

3. Payment

Payment is due in accordance with the invoice issued for your order unless otherwise agreed in writing.

Where Silver Dog Studios creates original artwork, restored images or video content involving creative editing beyond simple digitisation, copyright in those newly created works shall remain with Silver Dog Studios until payment has been received in full. Upon receipt of full payment, any copyright that is intended to transfer under the agreement shall automatically transfer to the client.

This clause does not affect any existing copyright ownership in the original materials supplied by the client.

4. Client Responsibility and Copyright

By submitting any photographs, negatives, slides, film, video, documents or other materials to Silver Dog Studios, you confirm and warrant that:

  • You own the original materials or have the legal authority to instruct us to scan, digitise, restore, print, copy or otherwise process them.

  • You have obtained any necessary permissions, licences or copyright authorisations required for the work requested.

  • The materials supplied do not infringe the intellectual property rights, privacy rights or any other legal rights of any third party.

  • The materials are lawful to possess, reproduce and process.

  • Where the materials contain identifiable individuals, you have any permissions required by law for the work requested.

You accept full responsibility for the accuracy of these declarations.

You agree to indemnify and hold harmless Silver Dog Studios against any claims, losses, damages, legal costs or expenses arising from any breach of the above warranties or from any instruction given by you which infringes the rights of another party.

5. Content Standards

Silver Dog Studios reserves the right to refuse to process any material that we reasonably believe:

  • Is illegal.

  • Infringes copyright or other intellectual property rights.

  • Contains unlawful or exploitative material.

  • May expose Silver Dog Studios to legal liability.

6. Care of Original Materials

We treat every item entrusted to us with the utmost care and use professional handling procedures throughout the scanning process.

Although every reasonable effort is made to prevent loss or damage, clients acknowledge that many original photographs, slides and films are unique and irreplaceable.

In the unlikely event that damage occurs while the materials are in our care, our liability shall be limited to the reasonable cost of repair or replacement of the physical media where such replacement is possible.

Silver Dog Studios shall not be liable for:

  • sentimental or emotional value;

  • loss of future value;

  • consequential or indirect losses;

  • loss of profits;

  • loss of opportunity;

  • or any claim exceeding the amount paid for the relevant service, except where liability cannot legally be excluded under applicable law.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or any liability that cannot be excluded under UK law.

7. Inspection of Work

Clients should inspect all digital files, prints and other delivered work as soon as reasonably practicable after receipt.

Any issues or concerns should be reported within 14 days of delivery so that we have the opportunity to investigate and, where appropriate, rectify the issue.

8. Storage of Digital Files

Unless otherwise agreed, Silver Dog Studios does not guarantee permanent storage of scanned files after delivery.

Clients are responsible for creating and maintaining their own backups once files have been delivered.

9. Third-Party Websites

Our Website may contain links to third-party websites.

Silver Dog Studios has no control over, and accepts no responsibility for, the content, availability or privacy practices of third-party websites or services.

10. Changes to these Terms

We reserve the right to amend these Terms from time to time.

The latest version published on our Website will apply to all future orders.

11. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
